General Terms of Use and Sale
The contract between Testaweb and its users: what the drafting and timestamping service does, what it does not do, and the commitments of each party.
1. Publisher, contact and hosting
1.1 The website https://www.testaweb.com and the Testaweb service are published by WEB EDITIONS II, whose registered office is located at .
1.2 All correspondence relating to these Terms is received at [email protected]. Billing questions are handled by Testaweb.com at [email protected], and personal data questions at [email protected].
1.3 The Website is hosted by OVHcloud (OVH SAS)., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus (https://www.ovhcloud.com), on servers located in the European Union.
1.4 These Terms were last updated on 10 September 2026.
2. Terms used in these Terms
2.1 The following words, when capitalized, have the meaning defined below.
- User
- The adult natural person who uses the Service to prepare their own last wishes.
- Account
- The secure personal space in which the User finds their Draft will, its versions, their Beneficiaries, their Attached documents, their Trusted contacts and the history of their file.
- Questionnaire
- The guided six-step process (civil status, family situation, beneficiaries, assets, wishes, executor) at the end of which the Service formats the User's answers.
- Draft will
- The PDF document produced by the Service from the User's answers. It is a typewritten template intended to be copied out by hand; in itself, it is not a will.
- Version
- Each validated state of the Draft will. A revision creates a new Version without altering the previous ones.
- Fingerprint
- The SHA-256 hash of a Version's PDF file: a string of 64 characters that identifies that exact file and does not allow its content to be reconstructed.
- Timestamp
- The recording of the Fingerprint on the public Bitcoin blockchain through the open OpenTimestamps protocol, and the certificate resulting from it.
- Beneficiary
- A person whom the User names in their Draft will as recipient of all or part of their assets.
- Trusted contact
- A person whom the User designates in their Account and to whom they assign an access level to their file.
- Attached documents
- The files the User uploads to their Account alongside their Draft will.
3. Scope and acceptance
3.1 These Terms govern the entire relationship between Testaweb and the User. They are supplemented by the Subscription Terms, the Refund Policy and the Privacy Policy, accessible from the footer of every page.
3.2 They are accepted at the time of payment, by the checkbox provided for that purpose. The applicable version is the one in force on the date of the order; any substantial change is notified by email at least thirty (30) days before it takes effect, and a User who objects to it may terminate free of charge before that date.
3.3 The Service is reserved for adult natural persons acting on their own behalf and having legal capacity to contract. It may not be used to prepare the will of a third party.
4. What the Service does
4.1 Testaweb is a drafting and safekeeping aid. It provides:
- a Questionnaire in plain language, saved as you type so that it can be resumed at the step where it was left;
- the formatting of the answers into a Draft will in PDF format, regenerated with each change before validation;
- general information reminders before validation, in particular on the form of the holographic will (testament olographe) and on forced heirship (réserve héréditaire);
- the Timestamp of each validated Version, and a public tool for verifying a Fingerprint;
- the keeping of Versions, Beneficiaries, Attached documents and a dated log of actions performed on the file;
- the designation of Trusted contacts and the choice, for each, of an access level described in Article 8.
4.2 The exact scope of each plan (Essentiel, Sérénité, Famille) — number of people, wills, Attached documents, level of support — is the one described on the Pricing page at the time of subscription.
4.3 The Draft will is produced solely from the User's answers. The Service does not verify the accuracy of those answers, the consistency of the declared estate, or the identity or existence of the persons named.
5. What the Service is not
5.1 Testaweb is neither a notary (notaire), nor a lawyer, nor a legal or wealth advisory firm, and provides no personalized legal advice. The information displayed by the Service, including by support, is general information on French law; it does not take into account the full situation of the User and does not replace the opinion of a legal professional.
5.2 In particular, Testaweb does not guarantee that the wishes expressed comply with the law applicable to the User's estate, that they respect forced heirship (réserve héréditaire), that they will produce the intended effect, or that they will not be challenged. The disposable-share calculation (quotité disponible) shown by the Questionnaire is indicative and rests solely on the User's declarations.
5.3 Testaweb is not an official depositary of wills and does not register the will with the French central register of last wishes (Fichier central des dispositions de dernières volontés): only a notary can do so. Testaweb does not guarantee that the will will be found, opened or executed upon the User's death.
5.4 For a large or complex estate, assets located abroad, a blended family, a business, or any situation in which the User has doubts, the support of a notary is recommended.
6. How the will becomes valid
6.1 The Draft will produced by the Service, whether displayed, downloaded, printed or timestamped, is not a valid will under French law. A typewritten or computer-generated document does not meet the formal requirements set by law.
6.2 To be valid as a holographic will (testament olographe), the text must be written entirely by hand by the User, and dated and signed by hand (Article 970 of the French Civil Code). The User may also have their will received by a notary, in authentic or mystic form. Compliance with these forms is the User's sole responsibility.
6.3 Depositing the handwritten original with a notary and its registration in the French central register of last wishes remain recommended: they ensure the will can be found upon death. The User keeps the handwritten original themselves; Testaweb neither receives nor keeps it, except for a copy the User would deposit among their Attached documents.
6.4 A new Version created in the Service replaces the previous one in the Account, but does not by itself revoke an earlier will that the User wrote by hand or had received by a notary. Revocation is governed by the rules of the French Civil Code, in particular by a later will drawn up in one of the legal forms.
6.5 The Service is designed with reference to French law. A User residing outside France, of foreign nationality, or holding assets abroad must check which law will govern their estate.
7. What the timestamp proves, and what it does not prove
7.1 When a Version is validated, the Service calculates the Fingerprint of its PDF file and submits it to the OpenTimestamps protocol, which records it on the Bitcoin blockchain. Only the Fingerprint is transmitted: no readable element of the Draft will is published.
7.2 The Timestamp shows that a strictly identical file existed no later than the date of the block containing the Fingerprint, and that it has not been altered since. Anyone can verify this, without an account, by submitting the Fingerprint to the Website's verification tool, which only indicates whether it has been anchored and on what date.
7.3 The Timestamp does not prove the identity of the author, their consent, their capacity, or the validity or effectiveness of the will. It covers the PDF file produced by the Service, not the handwritten copy, nor the Attached documents.
7.4 Recording depends on OpenTimestamps servers and the Bitcoin network, which are not operated by Testaweb. Final confirmation usually occurs within a few hours, with no guaranteed delay; in the event of failure, the Fingerprint is kept and submission is retried automatically.
8. Trusted contacts and access to the file
8.1 During the User's lifetime, only the User has access to the content of their file, subject to the Trusted contacts to whom they have themselves granted immediate access.
8.2 For each Trusted contact, the User chooses one of the following access levels, which can be changed or revoked at any time from their Account:
| Access level | What the person can do | From when |
|---|---|---|
| Notification only | Be informed that the will exists, without being able to read it | From the time of designation |
| Access when the time comes | View and download the will and its timestamp proof | After a death certificate has been submitted and verified |
| Immediate access | View the will without waiting | From the time of designation |
8.3 Testaweb is not automatically informed of a User's death. Access when the time comes is opened only at the request of a designated Trusted contact, upon submission of a death certificate checked by the Testaweb team: no access is opened on the basis of a simple declaration. Testaweb may request any additional supporting documents and refuse access in case of doubt.
8.4 Access is opened only to the persons designated by the User, within the limits of the chosen level. An heir, a Beneficiary or a third party who has not been designated as a Trusted contact obtains no access through Testaweb, unless by court order or at the request of a legally authorized authority.
8.5 The copy viewed by a Trusted contact is the Draft will. It does not have the value of the handwritten or notarized original, which relatives must seek from the notary handling the estate.
8.6 Every designation, change, withdrawal and access is dated and kept in the file log. Removing a Trusted contact revokes their access without delay.
9. Account and User obligations
9.1 A Questionnaire draft may be started without an Account. Validation, Timestamping and keeping a Draft will require one, which is created at the time of payment.
9.2 Login details are personal and confidential. Any action performed from the Account is deemed to have been carried out by the User, who must inform Testaweb without delay, at [email protected], of any use they have not authorized.
9.3 The User undertakes to provide accurate information and to re-read each Version in full before validating it and then copying it out. The User alone is responsible for the content of their wishes.
9.4 By entering the details of Beneficiaries, an executor or Trusted contacts, the User declares that they are entitled to share this information and undertakes to inform the persons concerned that their data is kept by Testaweb, in accordance with the Privacy Policy.
9.5 Attached documents must relate to the User's estate or wishes. Uploading unlawful content, a malicious file, or a document the User is not entitled to hold is prohibited.
10. Price, payment and subscription
10.1 The Service is sold as a 48-hour trial at EUR 1.90, charged at the time of ordering, which automatically continues, unless cancelled before it ends, as an annual subscription to the plan chosen at ordering. The annual price of each plan is shown on the Pricing page and repeated on the payment page before validation.
10.2 Prices are shown inclusive of all taxes, in the displayed currency. The applicable price is the one shown at the time of ordering.
10.3 Payment is made by bank card or digital wallet through a PCI-DSS certified payment provider. Card details are entered directly with that provider and are never stored by Testaweb. The order authorizes the charge of the registered payment method at each due date until cancellation.
10.4 The subscription can be cancelled at any time from the Account, free of charge and without justification. The rules on renewal, cancellation and non-payment are set out in detail in the Subscription Terms.
10.5 An invoice is issued for each charge and made available in the Account.
11. Right of withdrawal
Consumers in the European Union and the EEA
11.1 The consumer has fourteen (14) days from the conclusion of the contract to withdraw, without having to give reasons, in accordance with Directive 2011/83/EU and Article L221-18 of the French Consumer Code (Code de la consommation).
11.2 The Draft will is digital content produced and timestamped as soon as payment is confirmed. By placing the order, the User expressly requests immediate performance of the Service and acknowledges that they lose their right of withdrawal for that content once it has been delivered (Article L221-28 of the French Consumer Code). The trial amount is therefore not refundable on the basis of withdrawal once the Draft will has been produced.
11.3 For the annual subscription following the trial, a consumer who withdraws within the fourteen (14) day period is refunded the amount charged, less an amount proportional to the period already elapsed (Article L221-25 of the French Consumer Code). Details are set out in the Refund Policy.
11.4 To withdraw, it is enough to send an unambiguous statement to [email protected], from the email address on the Account, within the time limit.
Professionals
11.5 The Service is intended for individuals. No right of withdrawal applies to a contract concluded for professional purposes.
12. Availability and liability
12.1 Testaweb endeavors to keep the Service accessible at all times, subject to maintenance operations and incidents affecting third-party networks and providers. The Service is provided under a best-efforts obligation.
12.2 Testaweb is not liable for the nullity, ineffectiveness, reduction or challenge of a will, nor for the inheritance consequences of the wishes expressed by the User, nor for the absence of handwritten copying, date or signature, nor for the absence of deposit with a notary.
12.3 Testaweb is not liable for the operation of the Bitcoin blockchain or the OpenTimestamps servers, nor for access obtained using login details the User has disclosed, nor for access opened to a Trusted contact in accordance with the level chosen by the User.
12.4 To the extent permitted by law, the liability of Testaweb is limited to the sums actually paid by the User during the twelve (12) months preceding the event giving rise to liability. Nothing in these Terms limits the liability of Testaweb in the case of gross negligence or wilful misconduct, nor the rights the consumer holds under mandatory provisions.
12.5 Neither party is liable for a failure to perform resulting from a case of force majeure.
13. Intellectual property
13.1 The Website, its interface, the Questionnaire, the drafting templates and the Testaweb trademark remain the property of WEB EDITIONS II. The User receives a personal, non-transferable right to use them for the duration of their access.
13.2 The wishes expressed by the User, and the Draft will containing them, belong to the User. They may download, print, copy out and hand them to any person of their choice.
14. Personal data
14.1 A will reveals information about the author's family, estate and sometimes beliefs. This data is processed in accordance with the Privacy Policy published on the Website and with Regulation (EU) 2016/679 (GDPR): it is neither sold nor used for advertising purposes.
14.2 The Privacy Policy sets out who can access the file, for how long it is kept and how it is deleted.
15. Suspension, termination and deletion of the Account
15.1 Testaweb may suspend or close an Account in case of fraud, identity theft, non-payment or serious breach of these Terms — immediately where the breach is serious or unlawful, and after a formal notice that remains without effect in other cases.
15.2 The User may request deletion of their Account at any time, from the website's data erasure request page or by writing to [email protected]. Deletion erases the Draft will and all its Versions, the Beneficiaries, the Trusted contacts, the Attached documents and the file log, under the conditions and time limits of the Privacy Policy. Trusted contacts then lose all access.
15.3 The Fingerprint recorded on the public blockchain cannot be erased; it contains no readable data and does not allow the document to be reconstructed. Before deleting their Account, the User is invited to download their documents and their timestamp certificates.
15.4 Cancelling the subscription does not delete the Account, and deleting the Account does not, by itself, constitute a request for a refund.
16. Governing law and disputes
16.1 These Terms are governed by the law of the country where WEB EDITIONS II is headquartered, without prejudice to the mandatory provisions more protective of the law of the consumer's habitual country of residence.
16.2 Any complaint must first be sent to [email protected]. Failing an amicable resolution, the consumer may, free of charge, refer the matter to a consumer mediator (médiateur de la consommation) or to the European Online Dispute Resolution platform.
16.3 Failing agreement, the competent courts are those of the registered office of WEB EDITIONS II, subject to the mandatory rules of jurisdiction that allow the consumer to bring proceedings before the courts of their domicile.
